The terms for purchase and use

These Terms

(1) This website (the “Site”) and/or the services, including related mobile apps (the “Services”), and all offers and sales of products (“Products”) via the Site are owned and operated by BETTER3 GmbH (“we”, “us”, “our”). These Terms set out the conditions under which visitors/users (“Users”, “you”) may use the Site/Services and purchase Products.

(2) By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Site/Services.

(3) You confirm you are of legal age and capacity; minors require parental/guardian consent.

Purchase of Products

(1) The then-current Terms apply.

(2) Read the item description before ordering. Clicking “Order with obligation to pay” may create a binding contract, subject to these Terms.

(3) Add items to cart, review prices (incl. VAT and shipping) and correct errors before submitting. Delivery times run from payment receipt. By clicking “Order with obligation to pay” you place the order and accept these Terms.

(4) You will receive an automatic email acknowledgement (not an acceptance).

(5) The contract is concluded when we send an acceptance email or dispatch the goods. Exception for immediate-payment methods (e.g., PayPal/instant transfer): conclusion occurs when you submit the order.

(6) Contract language: German. We store the contract terms; you will not have access to them.

Right of Withdrawal

For goods delivered in a single shipment, you may withdraw within 14 days without giving reasons, starting when you or a third party (not the carrier) take physical possession of the goods.

Notify us by clear statement (letter or email) including: full name, address, phone, email, order number, item number(s) & quantity. Use of the model form is optional. Timely dispatch of the notice suffices.

Effects

We refund all payments incl. delivery costs (except extra costs for non-standard delivery) without undue delay and at the latest within 14 days of receiving your notice, using the original payment method. We may withhold the refund until we receive the goods back or you provide proof of return.

Return the goods without undue delay and no later than 14 days after your notice. You bear the direct return costs. You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Product Warranty

Statutory warranty rights apply for defects in quality or title.

Storage of Online Payment Data

Saved payment methods are stored in line with applicable industry standards (e.g., PCI-DSS). Cards can be identified by their last four digits.

Vouchers, Gift Cards & Offers

Offers are valid for the stated period only and may not be transferred, modified, sold, exchanged, duplicated or distributed without our prior written consent.

Member Account

(1) Some features require an account with accurate and complete information.

(2) Keep credentials secure; actions via your account may be attributed to you.

(3) Sign-in may be via third-party platforms (e.g., Facebook); we receive the necessary profile data.

(4) We may suspend/restrict access to protect us, the Site/Services or users; we inform you as soon as feasible. We may terminate the account program with notice; you may request deletion at any time.

Acceptable Use

Private, non-commercial use only. Prohibited activities include unlawful/fraudulent use, bypassing security, disruption, sending unlawful content/spam, harmful code, scraping/monitoring without permission, and commercial use without consent. You agree to cooperate in investigations.

Intellectual Property

All rights in the Services and content are owned by or licensed to us; no rights are transferred unless required by law or expressly granted. For digital content, rights are as stated on the Site.

Disclaimer (Site/Services)

Free Services/information are provided “as is”, without warranty of uninterrupted/error-free availability. Maintenance/updates may limit access. Product warranty remains unaffected.

Indemnification

You agree to indemnify and hold us harmless from claims, costs and damages arising from your unlawful or contractual breach, to the extent attributable to you.

Limitation of Liability

Liability exists for intent/gross negligence, injury to life/body/health, or breach of essential contractual duties; for the latter limited to typical, foreseeable damage. Product liability and expressly assumed guarantees remain unaffected. Applies to pre-/non-contractual liability and for our officers/employees/agents.

Changes to Terms & Services; Discontinuation

We may amend Terms (e.g., due to law/features). New Terms apply to new orders. For ongoing Services we inform in due time; you may object within two months. We may modify/discontinue Services while considering legitimate interests.

Third-Party Links

We are not responsible for external content; links are for information and do not imply endorsement.

Governing Law

(1) Austrian law applies (excluding conflict-of-laws rules).

(2) EU ODR platform: https://ec.europa.eu/consumers/odr/. We are not obliged to participate in alternative consumer dispute resolution.

Miscellaneous

• No waiver by omission.
• Headings are for convenience only.
• If any provision is unlawful/unenforceable, the remainder remains in force.
• No assignment without our prior written consent.
• These Terms supersede prior agreements.
• Provisions intended to survive (e.g., liability, indemnity) remain in effect.
